The Hidden Risks of AI-Written Policies and Tender Responses

More UK SMEs are using ChatGPT, Microsoft Copilot, Google Gemini and Claude to draft their policies, tender responses and accreditation evidence. Used as a first draft, this is a sensible use of time. Submitted without a human review pass, it is becoming one of the fastest routes to a failed audit, a rejected tender, or a regulator finding.

Auditors, accreditation bodies and procurement teams have spent two years learning the patterns. They know what an AI-drafted policy looks like, and they know where to push to find out whether the business actually runs to it. A polished document that does not match the business is now a red flag, not a reassurance.

This guide sets out where SMEs are getting caught, the accreditation schemes where it is biting hardest, and what a human review pass needs to cover before a document leaves the business.

Why AI-Drafted Documents Are Failing Audits and Tenders

The core problem is not that AI writes badly. It writes fluently. The problem is that fluent does not mean accurate, current, or specific to the business that is submitting the document.

A May 2026 Microsoft Research study found that even the best AI models silently corrupt around a quarter of document content during multi-step editing workflows, and that frontier models hide their errors inside the text rather than deleting content (VentureBeat, 13 May 2026). The document still reads cleanly, but clauses have been subtly rewritten, figures shifted, dates changed, and references invented.

For an SME submitting a policy pack to an accreditation auditor, or a 50-page tender response to a public sector buyer, that is a problem you cannot spot by reading the final document. It needs a structured human review against the business and the standard.

Where SMEs Are Most Exposed

The risk concentrates on a handful of document classes that SMEs are most likely to draft with AI and most likely to be judged on:

  • Employee handbooks and HR policies. AI tends to mix UK, US and EU employment law in the same document, quote out-of-date statutory thresholds, and produce grievance and disciplinary procedures that are too generic to pass an ACAS comparison.
  • Information security policies. AI-drafted ISMS documentation often references frameworks the business does not actually operate (NIST, SOC 2, HIPAA) and misses the Cyber Essentials or ISO 27001 control language an assessor expects.
  • Tender and RFP responses. AI invents case studies, misnames clients, exaggerates accreditations the business does not hold, and slips in clauses the business cannot actually deliver. Buyers cross-check.
  • Accreditation evidence packs. Statement of Applicability documents, risk assessments and method statements drafted by AI frequently fail the "does this match how you actually work" test in stage 1 audits.
  • Quality manuals and procedures. AI-drafted ISO 9001 documentation reads well but often contains controls the business does not run, omits processes it does, and references clauses from the wrong edition of the standard.
  • Modern slavery, anti-bribery and ESG statements. AI happily writes a long, confident statement on supply chain due diligence the business has not actually carried out. This is a direct exposure under the Modern Slavery Act 2015 and the Bribery Act 2010.

Each of these documents is now plausibly being drafted by AI in SMEs across the UK economy. Each is also a document an external party will read carefully.

What Goes Wrong Inside an AI-Drafted Policy

Common patterns we see when reviewing AI-drafted documents for clients:

  • Wrong jurisdiction. The document quotes US federal law, OSHA, GDPR (rather than UK GDPR), or EU directives that do not apply to the SME directly.
  • Out-of-date thresholds. Statutory sick pay rates, national minimum wage, holiday entitlement and parental leave qualifying periods are quoted from older versions of the law. The Employment Rights Act 2025 changes from April 2026 are routinely missed.
  • Invented citations. AI confidently cites case law that does not exist, regulator guidance that was never published, or section numbers that do not match the actual statute.
  • Mismatched controls. An information security policy references controls the business does not operate. Penetration testing, SOC monitoring and dedicated security officer roles appear in policies for businesses that do none of these things.
  • Generic risk assessments. Risk registers that read like every other AI risk register, with no link to the actual hazards in the business. An auditor opens it, sees no site-specific detail and downgrades the score.
  • Tone drift. Different sections of the same policy read like they were written by different people because the AI produced them across separate sessions with no consistency check.
  • Internal contradictions. Policy says one thing, procedure says another, and the appendix says a third thing. AI does not check across the document set.
  • Phantom roles. Accountabilities sit with job titles the business does not have. The "Chief Information Security Officer" in an eight-person firm. The "Data Protection Officer" where the business is not required to appoint one.

None of these are catastrophic on their own. Stacked together across a 60-page policy pack, they cost the business the accreditation or the tender.

The Signs an Auditor or Buyer Will Spot

External reviewers are now trained to spot AI-drafted documents and to probe the gap between the document and the business. The red flags they look for include:

  • Documents that are far more sophisticated than the size and maturity of the business would suggest
  • Policies with no version control history, no named author, no review date and no sign-off
  • Identical phrasing across multiple sections, or phrasing identical to other businesses' submissions
  • References to controls, roles or processes the business cannot produce evidence of
  • Generic risk assessments with no site or process-specific detail
  • Documents quoting US, EU or out-of-date UK law where the current UK position is different
  • "Mission" or "values" prose that reads like marketing copy rather than operational policy

When an auditor or buyer spots two or three of these in a pack, they push harder. Probing questions, evidence requests and on-site spot checks follow. That is where the document falls apart.

Accreditation Schemes Where This Is Biting

The schemes most affected are the ones where SMEs depend on accreditation to win or keep work:

  • Cyber Essentials and Cyber Essentials Plus. Assessors look for evidence that the policies map to the controls actually in place. Generic AI-drafted ISMS documentation regularly fails.
  • ISO 9001, ISO 14001, ISO 45001, ISO 27001, ISO 42001. Stage 1 audits compare the management system documentation to the operation. AI-drafted manuals that do not match are flagged as major non-conformities.
  • CQC, Ofsted, FCA, SRA. Regulators with the power to publish findings and restrict licences are increasingly explicit that documentation must reflect the actual service or operation, not a generic template.
  • FSQS, Achilles, JOSCAR, Constructionline. Supplier qualification schemes where SMEs upload policies and evidence. Inconsistencies between documents and submitted facts are flagged.
  • NHS DTAC, DCB0129 and DCB0160. Suppliers to the NHS must produce documentation that genuinely reflects their controls. Generic AI output is now routinely returned for rework.
  • Public sector tenders and frameworks. Crown Commercial Service frameworks, Social Value, Net Zero and Modern Slavery responses are scored against credibility, not just word count.
  • Private sector procurement. Larger buyers expect SME suppliers to provide documentation matched to their operation. Suspect submissions trigger supplier risk reviews.

For SMEs whose growth depends on these schemes, an AI-drafted document pack that fails first review is not a small setback. Reauditing, rewriting and resubmitting costs months, and in some cases the buyer simply moves on.

The Case for a Human Review Pass

AI is a useful first draft. It is not a finished policy. The human review pass exists to bridge that gap, and to give the SME a document pack that will stand up to external scrutiny.

A proper human review pass does three things at once. It checks the document against the actual business, against the current UK regulatory position, and against the standard or scheme the document will be judged by. None of those checks happen reliably without a human who knows what they are looking for.

For most SMEs, this is not a job their internal team has the time or the regulatory depth to do well. Compliance and HR sit alongside operational delivery, and the review window before an audit or submission is short.

What the Review Pass Does Not Replace

A human review pass is not a substitute for the business actually running to the policies. If the document says the business runs monthly access reviews and the business does not, the review will flag it and either remove the claim or recommend the business start running them.

Equally, the review pass is not a route to make a document say something the business cannot evidence. Auditors will check, buyers will check, and regulators will check. The point of the review is to make the document accurate, not to make it look better than the operation.

AI can still write the first draft. The review pass closes the gap between fluent AI output and a document that holds up.

Practical Checklist Before Any AI-Drafted Document Leaves the Business

  1. Confirm the legal and regulatory references are UK current as of the submission date.
  2. Confirm every named control, role and process is one the business actually operates.
  3. Confirm the document aligns to the standard, scheme or tender it will be read against.
  4. Cross-check policy, procedure and appendix for internal consistency.
  5. Remove invented citations, case law and statistics. If a number is not sourced, it does not stay in the document.
  6. Populate author, version, review date and sign-off.
  7. Where the document claims an activity is in place, identify the evidence the auditor will ask for.
  8. Have a competent human read the final version end to end before submission.
