Why policies matter in health and social care

Health and social care providers have a legal duty to operate with documented policies and procedures. Under the Health and Social Care Act 2008, any organisation providing a regulated activity must be registered with the CQC and meet its fundamental standards.

Those standards require written policies covering everything from safeguarding and medication management to infection control and complaints handling. Without them, you cannot register and you will not pass inspection.

Care settings deal with vulnerable people, complex medication regimes, lone working, and situations where things can go wrong quickly. A clear policy gives your staff a documented process to follow. It removes guesswork, reduces variation in practice, and gives managers something to refer back to when things do not go to plan.

The CQC, Ofsted, and local authority commissioning teams all expect to see policies that reflect your actual service. Generic templates will not pass scrutiny. If your policies read like they could belong to any provider, that is a red flag.

Legislation that governs your policies

The policies we write are built around the legislation that applies to your service. Here are the key Acts and regulations we work with:

  • Health and Social Care Act 2008- Registration and regulation of health and social care services by the CQC
  • Care Act 2014- Duties around adult safeguarding, wellbeing, and care planning
  • Mental Capacity Act 2005- Assessing capacity and making best interest decisions
  • Safeguarding Adults under the Care Act 2014- Local authority duties and the six safeguarding principles
  • Children Act 1989 and 2004- Welfare of the child and inter-agency cooperation
  • Equality Act 2010- Anti-discrimination duties covering service users and staff
  • Data Protection Act 2018 and UK GDPR- Processing, storing, and sharing personal and sensitive data
  • Health and Safety at Work Act 1974- Employer duties for safe working environments
