Ofgem and the Licensing Regime

Ofgem is the energy regulator for Great Britain. It grants the licences the market runs on, writes their conditions, monitors compliance and takes enforcement action when licensees fall short.

Section 4 of the Electricity Act 1989 makes it an offence to generate, transmit, distribute or supply electricity without a licence, and section 5 of the Gas Act 1986 does the same for conveying and supplying gas. The Electricity Act also lets the Secretary of State exempt classes of activity, which is how many smaller renewable generators operate. Licensed or exempt, investors, insurers and offtakers still expect documented procedures behind your operations.

Health and Safety on Energy Sites

Energy work concentrates the hazards the HSE cares most about: electricity, height, confined spaces and lone workers on remote sites. The Health and Safety at Work etc. Act 1974 places the general duty on the employer, and HSE guidance confirms your policy must be written down once you employ 5 or more people.

What policies does an energy company legally need?

The legal core is a written health and safety policy statement once you have 5 or more employees under the Health and Safety at Work etc. Act 1974, safe systems of work for electrical activities under the Electricity at Work Regulations 1989, waste duty of care procedures under the Environmental Protection Act 1990, data protection documentation under UK GDPR and written employment particulars from day one under the Employment Rights Act 1996.

Do renewable energy providers need an Ofgem licence?

Whether an exemption applies depends on the scale and nature of what you do, so check your position before trading.

Do we need ISO 14001 certification or just an environmental policy?

It depends on what your clients and contracts ask for. Many tenders and due diligence questionnaires accept a clear environmental policy and documented management procedures, while larger contracts and some planning conditions expect certification to ISO 14001:2015 by an accredited body.
